1. Orders & Product Availability
All orders are subject to availability and confirmation by Little Pea Heenen Co. Product colours and appearance may vary slightly because of photography, screen settings and normal manufacturing variations. If an item is unavailable, we will contact the customer about the available options. We will not knowingly substitute a materially different product without the customer's agreement.
2. Pricing & Payment
Prices displayed or confirmed for an order apply subject to correction of genuine errors before acceptance. Payment arrangements will be communicated during the order process. An order may be held until required payment has been received and confirmed.
3. Clothing Sizes — Customer Responsibility
Where an item is sold by size, a size reference or size guide is provided. Customers are responsible for checking it and selecting the appropriate size before ordering. Little Pea Heenen Co. does not offer a voluntary exchange merely because a customer selected the wrong size where the exact size ordered was correctly supplied and the goods are not defective. This does not limit any return or cancellation right that applies by law.
4. Incorrect Item Supplied
If Little Pea Heenen Co. sends an item materially different from the item ordered, please notify us as soon as reasonably possible with the order details and, where reasonably requested, photographs. Once confirmed, Little Pea will arrange the reasonable return of the incorrect item at Little Pea's cost and provide the appropriate remedy, including the correct item where available or a refund where required or agreed.
5. Damaged, Defective or Unsafe Goods
Customers should inspect goods after delivery and notify us promptly of damage, defects, safety problems or material quality failures. South African consumer law provides an implied warranty of quality. Where goods qualify for the statutory remedy, including within the applicable six-month period, the customer may return them without penalty and at the supplier's risk and expense and may choose the remedy provided by law, which can include repair, replacement or refund. Little Pea may reasonably inspect returned goods to establish the nature and cause of the reported problem without limiting statutory rights.
6. Customer-Caused Damage
Little Pea Heenen Co. is not responsible for damage caused after delivery through misuse, abuse, negligence, accidental damage, incorrect washing or care, unauthorised alterations, improper storage, ordinary wear and tear, or use contrary to reasonable instructions. If a return is requested for a problem found not to be attributable to Little Pea and not covered by a statutory right, reasonable collection, return or redelivery costs may be for the customer's account where lawful.
7. Change of Mind & Exchanges
Little Pea Heenen Co. does not provide a general voluntary return, refund or exchange merely because a customer changes their mind, chooses the wrong size, no longer wants the item or prefers another product. This policy does not remove statutory rights. Certain electronic transactions may carry cancellation or cooling-off rights under the Electronic Communications and Transactions Act, subject to that Act's requirements and exceptions.
8. Refunds
Refunds are not automatically available for every return. A refund will be provided where required by applicable South African consumer law or where Little Pea agrees that it is the appropriate remedy. This may include qualifying defective goods, an incorrect item supplied where a refund is the appropriate remedy, or another situation in which legislation gives the customer a refund right. Nothing in these terms contracts out of non-waivable consumer rights.
9. Delivery
Delivery times are estimates and can be affected by the selected delivery service, destination and circumstances outside Little Pea's reasonable control. Customers must provide complete and accurate delivery information. Where PAXI or another third-party delivery service is used, the applicable option and charge will be communicated or displayed during ordering.
10. Order Cancellations
Please contact Little Pea as soon as possible to request cancellation. Whether an order can be cancelled before dispatch depends on its processing status and applicable law. Any statutory cancellation or cooling-off right remains unaffected.
11. Care & Returned Goods
Customers should follow product washing, care and safety instructions. Where a return is permitted, goods should be returned with reasonably available packaging, components and information unless the nature of the defect or applicable law makes this unreasonable.
12. Website Information
We take reasonable care to keep product information accurate. Images are intended to represent products as closely as reasonably possible, but minor differences in colour or appearance can occur between screens and physical goods.
13. Personal Information
Information supplied for enquiries, orders, delivery and customer service will be used for legitimate business purposes connected with those activities and handled in accordance with applicable South African privacy law, including the Protection of Personal Information Act where applicable.
14. Statutory Consumer Rights
Nothing in these terms excludes or limits liability or consumer rights where doing so is prohibited by law. These terms must be read subject to the Consumer Protection Act 68 of 2008, Electronic Communications and Transactions Act 25 of 2002 and other applicable South African legislation.
15. Governing Law
These terms and retail transactions with Little Pea Heenen Co. are governed by the laws of the Republic of South Africa. Customers retain access to consumer-protection remedies and dispute-resolution mechanisms available under applicable law.
16. Changes to These Terms
Little Pea Heenen Co. may update these terms from time to time. The terms applicable to an order are those made available in connection with that transaction, subject always to applicable law.
